A magistrate court sitting in Port Harcourt has granted bail to one Linus Brown 26 years old to the tune of 200,000 in like sum for stabbing one Micheal George at Bundu water side.
Reading the charges before the accused the defendant lawyer Bright C Nzewihe applied for bail on behalf of the accused. The prosecution counsel objected the bail application stating that the accused might not attend to court proceedings if granted bail. He noted that the crime for which the suspect is accused of is serious offence owing to the fact that his victim was seriously injured and has been bedridden at the Port Harcourt police clinic due to deep stab wounds and prayed that the victim should survive and recover from the wounds.
However, the defendant lawyer said the prosecutor was relying on speculation and the court is not bound by speculation. He said the accused has pleaded not guilty to the charges and pleaded that the accused be granted bail since the offense is a bail able under the laws of the federations.
Relying on section 36 sub 5 of the Nigeria constitution. Reading the charges, the magistrate ruled that the accused be granted bail to the tune of 200,000, and asked the accused to produce a shortee with a landed property within the Port Harcourt metropolis in the like sum.
