Fundamental Rights Suits Against IGP, CP & E-Crack Commander Filed By Late Chima Ikwunado”s Wife/Father At The High Court Suffers Setback

A Federal High Court in Port Harcourt has struck out the fundamental right suits, filed by Adaugo Ikwnado wife of Chima Ikwunado and Kelvin Ikwunado father of late Ikokwu mechanic against the Inspector General of Police, Commissioner of Police, E-crack Commander SP Benson Adetuyi,

The court struck out the suit after Counsel representing Ikwunado’s family Princess Lawrence applied to withdraw the suits due to errors in her applications.

Also, lawyers to the Police during the court proceedings filed an application seeking the court to dismiss the suits.

The Presiding Judge, Justice James Omotosho, after listening to the lawyers in the matter struck out the suits.

Justice Omotosho said the application does not seek Justice for the late Chima Ikwunado, but for people still living.

The Judge, however, refused to grant the application filed by the Police Counsel seeking to dismiss the case, on grounds that the Police Counsel filed their counter affidavit out of time.

In the meantime, the lawyer of the Police, Isokari Ego said the case was struck out because of the deficiencies in the applications by Ikwunado’s family.

Correspondent UGOCHUKWU IWUCHUKWU reports that the lawyer representing the Ikwunado’s family declined to speak on the court decision.
