A State High Court sitting in Port Harcourt has struck out a Fundamental Human Rights and murder chargers against the Inspector General of police, state Commissioner of police and former Commander of Anti-Robbery Squad, AKIN FAKORODE.
RONKE GBEREGBE who is the wife of late Chieftain of the the People’s Democratic Party in Khana, FERRY GBEREGBE approached the court to enforce fundamental Human Rights against the defendants and demanded for compensation for the murder of her husband who was allegedly murdered during the late General election in Rivers State.
Delivering Judgment in the matter, Justice ADOLPHUS ENEBELI struck out the matter for lacking in merit.
Justice ENEBELI based the judgment on the mood of application of the Fundamental Human Rights suit which he said ought to come in form of writ of summon Which gives room for witnesses and oral evidence and not originating summon and thereby struck out of suit.
Speaking to newsmen outside the court, counsel to the applicant, LIZENA AMEGUA said they will not appeal the judgment but will file a fresh charge against the defendants for the interest of justice.
