Justice G. O. Ollor of the State high court sitting in Port Harcourt has declined to hear the suit filed by the Rivers State government seeking to set aside the judgment releasing one hundred and fifty prisoners from Port Harcourt Correctional Centre.
Recall that last year December the high Court presided over by Justice Ollor delivered judgment releasing one hundred and fifty inmates after they have spent more than eight and to nine years without appearing in court since they were remanded.
When the matter came up today Justice Ollor excused himself and ordered that the case file be transmitted to the Chief Judge of the state for re-assignment. He said his reason for declining to entertain the matter is personal.
Our correspondent reports that before this decline the lawyer to the state government was expected to file his further affidavit on the reason why they want the court to stay the execution of the judgement.
