Court Dismisses Suit Against David Mark, Says It’s ‘Internal Issues, Party Should Handle It’

A Kastina State High Court has struck out a suit filed against the leadership of the African Democratic Congress (ADC), affirming that the matter is an internal party issue best resolved within the party’s structures.

Delivering the ruling on Wednesday, Justice A.K. Tukur dismissed the case brought by former Katsina State ADC Chairman, Usman Wamba, on the grounds that it lacked legal merit and had no basis before the court.

The judge emphasised that disputes of such nature fall within the domestic affairs of a political party and should not ordinarily warrant judicial intervention. According to the court, political parties possess the constitutional right to manage their internal processes, including leadership and organisational matters.

The suit had challenged the actions of a faction within the party aligned with former Senate President, David Mark, particularly concerning party activities in Katsina State.

The development follows an earlier order by a Katsina State High Court, which had restrained the ADC national leadership and the Independent National Electoral Commission (INEC) from recognising or participating in congresses organised by the defendants in relation to the party’s Katsina chapter.

However, in the latest ruling, Justice Tukur set aside the dispute, reinforcing the principle that internal disagreements within political parties should be resolved through party mechanisms rather than the courts.
