A Federal High Court sitting in Port Harcourt has struck out a suit filed by PAUL AROCHUKWU OGBONNA and one other representing a group known as Social Action against Attorney General of the Federation over the release of Forensic Audit Report of the Niger Delta Development Commission, NDDC.
The plaintiffs had in 2022 after Ministry of Niger Delta Affairs declined to furnish their Organization with the report of the Forensic Audit, filed a suit requesting the court to mandate the Ministry of Nigeria Delta Affairs headed by GOODWILL AKPABIO now the Senator President to furnish them with the NDDC forensic audit report.
You would recall that President BOLA TINUBU upon resumption to office, scribed the Ministry of Niger Delta Affairs, a development which prompted the representatives of Social Action to amend their processes and joined the Attorney General of the Federation as the legal authority of the country.
Delivering judgment on the suit, the presiding judge, Justice TURAKI MOHAMMED struck out the suit on the basis that the suit was filed against a non existing agency of the government.
While no counsel represented the AGF, during the judgment, the plaintiffs counsel, VICTOR NWEKE who spoke to newsmen outside the courtroom gave in details the reason for the suit and what has transpired over the years but expressed displeasure over the decision of the court, disclosing their readiness to taken the next available opportunity in ensure that the rights of his clients is not denied.
On his part, one of the plaintiffs, PAUL AROCHUKWU OGBONNA who is the head of legal of Social Action in Rivers State, said the suit is one of their efforts in keeping their anti corruption campaign but expressed displeasure over the position of the court, insisting that it was within their right to know what has happened to millions of naira has been invested into NDDC through the report of the forensic audit
