Appeal Court Denies Anyanwu’s Request For Stay Of Execution, Bars Him From PDP National Headquarters

The Court of Appeal has delivered another legal blow to Senator Samuel Anyanwu, the ousted National Secretary of the Peoples Democratic Party (PDP), by denying his application for a stay of execution on the December 20, 2024 judgment that removed him from office. This judgment upheld the appointment of Rt. Hon. Udeh Okoye as the party’s National Secretary.

With this latest ruling, Senator Anyanwu is legally barred from accessing the PDP national headquarters or performing any functions in the capacity of National Secretary until his appeal at the Supreme Court is heard and decided

The court’s decision reinforces the earlier judgment, stating that Anyanwu is not legally eligible to act as the party’s National Secretary. He also cannot attend meetings or present documents on behalf of the office

.A stay of execution in Nigerian law temporarily suspends the enforcement of a judgment pending further appeals. However, the Appeal Court found that Anyanwu failed to meet these criteria. The denial of the stay signals the court’s determination to uphold its previous decision and prevent the potential disruption that a stay might have caused. Legal experts explain that an appeal does not automatically grant a stay of execution; it must be specifically requested and granted by the court. For now, the PDP remains under the leadership of Rt. Hon. Udeh Okoye, while Anyanwu’s legal options narrow to his pending Supreme Court appeal.
